Terms of Service

1. Acceptance & scope

By downloading, installing, or using any of our mobile applications or accessing this website, you agree to these Terms of Service ("Terms"). If you do not agree, do not use our apps or website.

These Terms constitute a binding agreement between you and Yaroslav Pisotskyi ("we", "us", "Developer"), an individual developer based in Kyiv, Ukraine.

These Terms work together with our Privacy Policy, which describes how we handle your data.

2. The apps

These Terms apply to the following applications:

• VitaminHelper AI vitamin and supplement coach (in development; iOS and Android)
• Sleep Therapy Sleep Therapy: AI Assistant (iOS and Android, live)
• Dream Oracle Dream analysis app (Android, live)

App-specific provisions in these Terms apply only to the relevant app where indicated.

3. Eligibility

You must be at least 18 years old to use our apps. By using the apps, you represent that you meet this requirement. VitaminHelper processes health-related information and is intended exclusively for adult users.

If you are using the apps on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

4. Account

Some features require an account created via Google Sign-In, Apple Sign-In, or email authentication. You are responsible for:

• Providing accurate registration information
• Maintaining the security of your account credentials
• All activity that occurs under your account

Notify us immediately at sleeptherapy.app@gmail.com if you suspect unauthorized access to your account.

You may delete your account at any time via Settings → Delete account in the app, or by emailing us. See our Privacy Policy for details.

5. Subscriptions & payments

5.1 Auto-renewable subscriptions

Some features require a paid subscription. Subscriptions automatically renew unless cancelled before the end of the current billing period.

5.2 Apple App Store (iOS)

• Payment is charged to your Apple ID account at confirmation of purchase.
• Subscription renews automatically unless cancelled at least 24 hours before the end of the current period.
• Manage or cancel subscriptions in Settings → Apple ID → Subscriptions on your device.
• Price changes (2026): If we increase subscription prices, Apple will notify you and require your explicit consent before the new price takes effect, in accordance with Apple's updated subscription policies.
• Free trial periods, if offered, convert to paid subscriptions unless cancelled before the trial ends.

5.3 Google Play (Android)

• Payment is charged to your Google Play account at confirmation.
• Subscriptions renew automatically unless cancelled before the renewal date.
• Manage or cancel in Google Play → Subscriptions.
• Google Play Family Library and family sharing rules apply where enabled.

5.4 Refunds

Refunds are handled by Apple or Google according to their respective policies. We cannot process refunds directly. Contact Apple Support or Google Play Support for refund requests.

5.5 EU consumer rights

If you are a consumer in the European Union, you have a 14-day right of withdrawal for digital content purchases. By starting to download or use subscription content immediately after purchase, you expressly consent to immediate performance and acknowledge that you lose your right of withdrawal once performance begins.

6. AI-generated content disclaimer

Our apps use artificial intelligence to generate dream interpretations, mood analyses, vitamin recommendations, chat responses, and other content ("AI Output").

• AI Output may be inaccurate, incomplete, or inappropriate. It is provided for informational and entertainment purposes only.
• Do not rely on AI Output for medical, legal, financial, or other critical decisions.
• AI Output does not represent the views or advice of the Developer or any licensed professional.
• We do not guarantee the accuracy, reliability, or suitability of any AI Output.

7. Health disclaimer (VitaminHelper)

Sleep Therapy and Dream Oracle provide wellness and self-reflection tools. They are not substitutes for professional mental health care. If you are experiencing a mental health crisis, contact a qualified professional or emergency services immediately.

8. User content

You may submit content including dream descriptions, mood notes, lab test uploads, chat messages, and health information ("User Content").

• You retain ownership of your User Content.
• You grant us a limited, non-exclusive license to store, process, and transmit your User Content solely to provide and improve the apps (including AI processing as described in our Privacy Policy).
• You represent that you have the right to submit User Content and that it does not violate any third-party rights or applicable laws.
• We may remove User Content that violates these Terms without notice.

9. Acceptable use

You agree not to:

• Use the apps for any unlawful purpose
• Reverse-engineer, decompile, or disassemble the apps
• Scrape, crawl, or use automated tools to extract data
• Upload malicious code, viruses, or harmful content
• Impersonate others or create multiple fraudulent accounts
• Share account credentials with third parties
• Attempt unauthorized access to our systems or other users' accounts
• Use the apps to provide medical advice to others
• Circumvent subscription or paywall mechanisms
• Harass, abuse, or harm other users

Violation may result in immediate account suspension or termination without refund.

10. Third-party services & affiliate links

Our apps integrate third-party services (Supabase, OpenAI, Google, Apple, RevenueCat, Branch.io) and may contain links to external sites including Amazon and iHerb (VitaminHelper).

• We are not responsible for third-party services, their content, or their privacy practices.
• Affiliate disclosure (VitaminHelper): Some product links in VitaminHelper are affiliate links. We may earn a commission if you purchase through these links, at no extra cost to you. This is disclosed in accordance with FTC guidelines and EU consumer protection requirements.
• External links do not constitute endorsement of third-party products or services.

11. Intellectual property

The apps, website, logos, design, code, and all related intellectual property are owned by Yaroslav Pisotskyi and protected by copyright, trademark, and other laws.

• These Terms grant you a limited, non-exclusive, non-transferable license to use the apps for personal, non-commercial purposes.
• You may not copy, modify, distribute, or create derivative works without written permission.
• "VitaminHelper", "Sleep Therapy", "Dream Oracle", and associated logos are trademarks of Yaroslav Pisotskyi.

12. Termination

We may suspend or terminate your access to the apps at any time, with or without notice, if you violate these Terms or if we discontinue an app.

You may stop using the apps and delete your account at any time. Upon termination:

• Your license to use the apps ends immediately
• We will delete your data per our Privacy Policy (within 30 days of a deletion request)
• Provisions that by nature should survive (disclaimers, liability limits, governing law) remain in effect

13. Disclaimer of warranties

THE APPS AND WEBSITE ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF AI-GENERATED CONTENT.

We do not warrant that the apps will be uninterrupted, error-free, or free of harmful components.

14. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YAROSLAV PISOTSKYI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE APPS.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE APPS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) USD $50.

Some jurisdictions do not allow limitation of liability for personal injury or certain consumer rights. In such cases, our liability is limited to the minimum extent permitted by law.

15. Indemnification

You agree to indemnify and hold harmless Yaroslav Pisotskyi from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the apps, your User Content, or your violation of these Terms or applicable law.

16. Governing law

These Terms are governed by the laws of Ukraine, without regard to conflict-of-law principles.

If you are a consumer in the European Union, United Kingdom, or another jurisdiction with mandatory consumer protection laws, those laws apply to the extent they cannot be waived by contract and override conflicting provisions of these Terms.

17. Dispute resolution

Before initiating legal proceedings, you agree to contact us at sleeptherapy.app@gmail.com and attempt good-faith resolution for at least 30 days.

If no resolution is reached, disputes shall be submitted to the competent courts of Kyiv, Ukraine, unless mandatory consumer law requires otherwise.

EU consumers: You may also use the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

18. Changes to these Terms

We may update these Terms at any time. Material changes will be notified via the app or email at least 30 days before taking effect where required by law. The "Last updated" date reflects the current version.

Continued use of the apps after changes constitutes acceptance. If you disagree with updated Terms, stop using the apps and delete your account.
